Art Commissions

Here you can find a detailed list of the commissions I offer as well as prices and instructions on how to apply. Please read the Terms and Conditions for commissions below before submitting any request forms. If you have any questions, feel free to include them in your contact form submission.

The Art of Lem requires all commissions requests be submitted via the proper forms attached to this page and all commission requests are required to be finalized with a signed, written agreement that includes a down payment before any production of artwork can begin. Below are samples of the contracts for traditional artwork commissions and digital artwork commissions. Please note these are blanket samples of the contracts that will be sent to the client upon the approved commission request and are subject to adaptation depending on the specific needs and requests of the client and artist.

The Art of Lem retains the right to refuse any work or requests from anyone who does not agree to the terms and conditions stated below. Any commission requests that refuse to sign and agree to these terms and conditions will be turned down.

Terms & Conditions for Digital Art / Non-Physical Commissions

Terms of Payment

Upon agreement of this contract, the Client agrees to pay upfront a Refundable Deposit of 100% of the total price of the artwork(s) of which they are commissioning which will include the type of licensing they desire to purchase for their work. The Artist agrees to hold the deposit until agreement of completion. Upon completion of commissioned artwork(s), the Artist will send photographic proof and letter of completion of the work. Should the client be satisfied with the work, they will receive all digital files/physical prints for the appropriate licensing agreement.

Licensing

Upon commissioning, the client will agree to terms and conditions of specific licensing agreements. (*licensing agreements will be discussed during the commission request stage)

Right of Refusal

Should one of the parties choose to end the agreement prior to the completion of the artwork(s), the Client will not owe any additional fees, the Artist will retain all rights for the refused artwork and refund the full payment to the Client.

Refund and Return Policy

Should the Client be unsatisfied with the purchased artwork(s) after they have received all final design files/printed works, no refund requested will be fulfilled and the Artist will retain full amount.

Damage and Loss Policy

Should the commissioned artwork(s) files be corrupted or deleted in the process of production, the Client may request termination of the project and receive a full refund which the Artist will fulfil. The client may likewise choose to continue production allowing a grace period for the artist to catch up on lost work. Should the printed commissioned artwork(s) be lost or damaged in the shipping process, a refund request may be issued. Upon mutual confirmation of the loss and damages by Client, Artist, and shipping company, a full refund will be issued to the Client. The Art of Lem will not be held liable or responsible for any damages or losses that may occur after confirmed delivery of printed commissioned artwork(s).

Accountability of Production

The Artist agrees to give consistent photographic and/or video updates of the commissioned artwork(s) up to the completion of the artwork(s). The Artist agrees to send photographic and/or video proof as well as a letter of completion upon completion of commissioned artwork(s). The Client may request changes to the commissioned artwork(s) up to the point of confirmation of completion. Prior to confirmation of completion the Artist and/or Client reserve the right to end the contractual agreement.

Time of Production and Delays Policy

The Client agrees to allow for x time (*subject to change based on the requested work) of production from the agreement of the contract to receive confirmation of completion of commissioned artwork(s). Should the Client not receive confirmation of completion of their artwork(s) within the agreed upon time frame, The Art of Lem will refund 15% of the total payment to the Client upon confirmation of completion of the work

Should the Client request changes to the commissioned artwork(s) during the production process within the last 10 days of the deadline of production the 15% discount will not be applied to the Client even should the Artist exceed the agreed upon time frame. The Client will not receive a discount for any delays from the artist due to sickness or natural disasters. The Artist will alert the Client of any delays that may occur during the time of production.

Copyright

The Artist reserves the Common-Law Copyright to all artwork(s) commissioned by the Client that are created by the Artist. This includes all reproduction rights and the right to claim statutory copyright. No artwork(s) created by the Artist may be reproduced or sold by Client without written approval of Artist.

Agreement for Sale and Purchase

By signing the contract, the Client agrees to all the terms listed in the contract and will immediately be required to pay the refundable deposit of 100% of the total of the commissioned artwork(s).

Terms & Conditions for Traditional Fine Art Commissions

Terms of Payment

Upon agreement of this contract, the Client agrees to pay upfront, a Non-Refundable Deposit of 25% of the total price of the artwork(s) of which they are commissioning. Upon completion of commissioned artwork(s), the Artist will send photographic proof and letter of completion of the work. Should the client be satisfied with the work, the full and final payment will be required at this time.

Right of Refusal

Should one of the parties choose to end the agreement prior to the completion and full payment of the artwork(s), the Client will not owe any additional fees and the Artist will retain the refused artwork and non-refundable deposit.

Refund and Return Policy

Should the Client be unsatisfied with the purchased artwork(s), within 10 days of receiving the commissioned artwork(s) the Client may request a refund and return. The commissioned artwork(s) must be returned to the artist within 10 days of requesting the refund to qualify for the refund. Within 1-3 business days of successful return of the artwork(s) to the Artist, a full refund (excluding the non-refundable deposit) will be issued to the Client.

Damage and Loss Policy

Should the commissioned artwork(s) be damaged or lost in the shipping process, a refund request may be issued. Upon mutual confirmation of the loss and damages by Client, Artist, and shipping company, a full refund will be issued to the Client (excluding the non-refundable deposit). The Art of Lem will not be held liable or responsible for any damages or losses that may occur after confirmed delivery of commissioned artwork(s).

Time of Production and Delays Policy

The Client agrees to allow for 3 months (*subject to change based on the requested work) of production from the agreement of the contract to receive confirmation of completion of commissioned artwork(s). Should the Client not receive confirmation of completion of their artwork(s) within the 3 month time frame, a compounding 30% discount will

be offered to client for the commissioned artwork(s) for each month the work is delayed. This discount will not apply after commissioned artwork(s) have been paid in full.

Should the Client request changes to the commissioned artwork(s) during the production process in the 3rd month of production the discount will not be applied and the Client will pay the original price for the artwork(s) even should the Artist exceed the 3 month mark. The Client will not receive a discount for any delays from the artist due to sickness or natural disasters. The Artist will alert the Client of any delays that may occur during the time of production.

Copyright

The Artist reserves the Common-Law Copyright to all artwork(s) commissioned by the Client that are created by the Artist. This includes all reproduction rights and the right to claim statutory copyright. No artwork(s) created by the Artist may be reproduced or sold by Client without written approval of Artist.

Christmas Special Portrait Commissions

With the Holidays swiftly approaching, I will be doing a LIMTED TIME OFFER on Custom Portraits.

The Rules are simply. You can apply for a BLACK AND WHITE portrait out of 4 different options. Traditional portraits will be done in graphite and Digital portraits will be completed on Procreate via iPad. Digital portraits will be printed on either 8x10 paper or 11x14 paper. Accepting both Human Portraits and Pet Portraits.

ALL 8x10 portraits will be for a SINGLE SUBJECT PORTRAIT ONLY

ALL 11x14 portraits will be for FAMILY PORTRAITS ONLY
